No OBC Quota This Year : Supreme Court
Govt has no data, quota stayed: SC
"We are of the view that the impugned notification and enforcing the reservation for OBCs in the educational institutions must be put on hold as the Government has failed to provide any authentic or reliable data to justify its policy of reservation”
— The Bench
The Supreme Court on Thursday stayed the 27 per cent reservation for Other Backward Classes (OBCs) in elite educational institutions like IIMs and IITs. It added the Government's decision to implement the quota system was full of flaws.
Supreme Court today rejected the Centre's plea to vacate the stay on the implementation of 27 per cent OBC reservation in elite central educational institutions.
A Bench of Justice Arijit Pasayat and Justice L S Panta however said it would examine the Centre's plea for referring the issue to a Constitution Bench.
The Bench gave the order after the Solicitor General G E Vahanvati made a forceful plea for vacating the stay while arguing that the Apex Court had no power to pass any final order on the subject.
The Solicitor General's argument was that any final order on the matter can be passed only by a Constitution Bench and not by a two-judge Bench of the Apex Court.
